Terms of Service

These terms govern access to Ortho Copilot, including its clinical-documentation, patient-portal, and WhatsApp communication features.

1. Agreement and authorized use

By accessing Ortho Copilot, you agree to these terms and the policies of the healthcare organization that authorized your account. Organizations are responsible for assigning roles, maintaining lawful authority to process data, and ensuring that their users follow applicable clinical, privacy, records, and communication requirements.

2. Clinical responsibility

Ortho Copilot is workflow and documentation software. It is not a substitute for professional judgment, examination, diagnosis, treatment, prescribing, emergency services, or the official clinical record. Clinicians must review AI-generated drafts, medication schedules, visit instructions, alerts, and patient communications before relying on them.

3. WhatsApp is not an emergency channel

WhatsApp features support opted-in operational follow-up and access to secure portal content. They must not be used for emergencies, autonomous triage, medication changes, or unrestricted clinical disclosure. Anyone experiencing an emergency should contact local emergency services or the treating hospital through its designated urgent-care channel.

4. Accounts and acceptable use

  • Keep credentials confidential and use only your assigned identity.
  • Access only hospitals, patients, and records you are authorized to use.
  • Do not bypass controls, scrape data, introduce malware, or disrupt service.
  • Do not send spam, marketing, unlawful content, or communications that lack the patient consent required by the organization and Meta.
  • Promptly report suspected compromise or incorrect patient identity.

5. Patient and caregiver access

Portal and WhatsApp access may be provided to a patient or verified caregiver. A phone number alone is not proof of identity. Users must not share secure links or impersonate another person. Hospitals may revoke access when consent, identity, treatment relationship, or authority changes.

6. Third-party services

The service may depend on Supabase, Google Cloud, Meta/WhatsApp, transcription, AI, messaging, storage, and other providers. Their own terms may apply. Availability, message delivery, template approval, and platform limits can depend on those providers and are not guaranteed.

7. Ownership and feedback

Cubbing Solutions and its licensors retain rights in the software, interfaces, documentation, and service materials. Healthcare organizations and users retain the rights they have in submitted data. You grant us the limited rights needed to operate, secure, support, and improve the contracted service. Feedback may be used without obligation.

8. Suspension and termination

Access may be suspended or terminated for security risk, misuse, unlawful activity, contract expiration, non-payment, or an organization’s instruction. Data return and deletion follow the applicable agreement, clinical retention duties, and our Privacy Policy.

9. Disclaimers and liability

To the extent permitted by law, the service is provided without implied warranties beyond an applicable written agreement. Cubbing Solutions is not responsible for clinical decisions, unauthorized user conduct, inaccurate unreviewed drafts, third-party outages, or failures caused by customer configuration. Liability is limited as stated in the applicable organization agreement and law.

10. Law, changes, and contact

These terms are governed by the laws of India, subject to mandatory rights and the dispute terms in the organization’s agreement. We may update these terms and will post the revised date. Questions may be sent to support@orthoscribe.in.
